Debt Collection
Debt Collection is defined as the steps we will take to collect money on your behalf from someone who is indebted to you and refuses to pay. If all your efforts to collect the money have been fruitless, it is advisable to contact your attorney and act as soon as possible – the older the debt, the more difficult it is to recover.
As a first step, a letter of demand is sent to the debtor for settlement of the debt within four business days and unless met by a positive response, it is followed up with a telephone call. This invariably leads to settlement of the debt or a payment arrangement. Taking legal action against the debtor is the second phase in the recovery process which we aim to avoid. This route is followed only in cases appropriate for summonses and where a debtor refuses to pay or ignores the demands. Once a summons has been issued and unless the debtor defends the action, a civil judgement can be obtained, and a warrant of execution proceeded with to attach the debtor’s movable property that can be sold in execution to defray the debt.
